Temporary Business Visas
York Immigration Services Australia has assisted a large number of Australian and overseas companies and employee applicants in securing their temporary business visas, either through overseas diplomatic posts or by way of application in Australia. This has helped ensure better business practices and viabilities for our clients' businesses and repeat applications for us through our satisfied clients.
There are two types of temporary business visas:
Subclass 457 (Long Stay) Visas
The Subclass 457 visa is a common way in which employers may sponsor overseas employees to work in Australia for a period between 3 months and 4 years. Over 45,000 Subclass 457 visas were granted in the year 2006-2007.
Applicants for the Subclass 457 visa are performed in 3 stages:
- Business Sponsorship Application
- Nomination Application (for the Position)
- Visa Application for the Employee

Employer Requirements
The sponsoring employer must demonstrate that:
- they are actively and lawfully operating;
- they will either introduce new technologies to Australia or they can demonstrate a record of, or commitment to, training Australians;
- they are directly employing the visa holder;
- they have a good business record;
- if they have previous sponsored employees, that they history of complying with immigration law;
- they are able to meet their sponsorship obligations;
- the position (job) meets the minimum skill and salary requirements*; and
- that the employee will benefit Australia, such as by contributing to Australian trade, improving international business links, contributing to competitiveness.
*There are special skill and salary requirements for employers in regional areas.
NB. Overseas business sponsors must meet additional requirements.
Employee Requirements
The employee must demonstrate that:
- they have the appropriate personal attributes or employment background for the nominated position; and that
- they meet the health and character requirements.
Depending on their proposed position and income, certain employees must also demonstrate that they have requisite English language skills.
Benefits for Employers
- This visa allows employers to sponsor staff for a period between 3 months to 4 years
- A sponsorship approval lasts 2 years, or until all nominations have been filled
- Businesses which have no formal operating base or representation in Australia may bring employees to Australia to:
- establish a branch, joint venture or agency distributorship and subsidiary branches in Australia; or
- fulfil obligations for a contract or other business activity in Australia
Benefits for Employees
Employees with this visa may:
- work in Australia for a period between 3 months and 4 years
- bring eligible secondary applicants with them (who may work and study)
- have multiple entry to and from Australia for the duration of the visa
Pathway to Permanent Residency
After 2 years of working in their nominated occupation in Australia, an employee may become eligible for permanent residency through the grant of an Employer Nomination Scheme Visa (Subclass 121/856). To be eligible the employee must have worked for at least the last 12 months with the nominating employer. Subclass 456 (Short Stay) Visas
These visas are for people who are employed overseas or have business interests overseas and wish to conduct business in Australia. There are two types:
- short 3 month visits to Australia; or
- multiple entries of no more than 3 months for the life of the visa for business purposes in Australia.
