Spouse Visa

York Immigration Services will provide you with full assistance in terms of documents and evidentiary requirements to succeed in obtaining residency status for your loved ones in Australia. As a general guideline, you may be eligible to reside in Australia if you are married or in a de facto relationship with an Australian citizen, Australian permanent resident or eligible New Zealand citizen. A de facto relationship is simply one where you have lived with your partner in a spouse-like relationship, even though you are not married. You must have lived in a de facto relationship for at least 12 months prior to the application.

You can still apply for a spouse visa if you are living overseas and are engaged to be married to an Australian citizen, permanent resident or eligible NZ citizen and intend to marry that person before entering Australia. However, you must marry that person before a spouse visa can be granted.

Obtaining a permanent resident visa as a partner involves two processes: initially, the provisional visa is granted, and two years thereafter, the permanent visa. However, this two year probation may be waived in exceptional cases, where your marriage is 5 years or longer, or you have a dependent child from that relationship.

Clients are provided with a list of supporting documents which are ordinarily required for applications lodged with the Department of Immigration and Multicultural and Indigenous Affairs (DIMIA). Each relationship is different and our preparation of individualised submissions enables DIMIA officers to promptly and accurately assess the genuine and continuing nature of your relationship. Our services are comprehensive – as a part of our services we will direct you with any final matters which may be outstanding during your two year probationary period. If you have been refused a spouse visa, we will realistically appraise your circumstances and if appropriate, will represent your matter before the Migration Review Tribunal.

Partner (Spouse)

Partner migration to Australia allows you to migrate to Australia to live with your loved one. This visa is for individuals who are

already married or in a de facto relationship (Spouse Visa) ; or

intending to marry overseas before coming to Australia (Spouse Visa) ; or

intending to marry in Australia (Prospective Marriage Visa) ;

with an Australian citizen or permanent resident or eligible New Zealand citizen.
